Terms of Service

1. Agreement Overview

Welcome to Groovement (hereinafter referred to as "this App"). These Terms of Service (hereinafter referred to as "these Terms") are the agreement between you and us regarding the use of this App and related services, and apply to all versions of this App released on the Apple App Store and domestic Android app stores (including but not limited to Huawei AppGallery and Tencent MyApp). We will update these Terms accordingly when new domestic Android channels are added.

By starting to use this App, you confirm that you have read, understood, and agreed to be bound by these Terms and the Groovement Privacy Policy. If you do not agree to these Terms, please stop using this App.

2. Services

This App is a local-first music tool for running and rhythm sports, mainly providing the following features:

1. Music import: add music through local music library scanning, the system file picker, or WiFi import;
2. BPM analysis and tempo adjustment: perform beat detection, energy trimming, and pitch-preserving tempo adjustment on imported local music;
3. Metronome and mixing: overlay a fixed-BPM metronome and generate playlists suited to a running rhythm;
4. Playback and management: local playback, library management, settings adjustment, playlist posters, and other auxiliary features;
5. Accounts and membership: login with an email verification code, subscription / purchase of membership benefits, restore purchases, and account deletion.

This App does not provide copyrighted music content. You should only import music files that you have the legal right to use or have obtained authorization from the rights holder, and you bear the relevant legal responsibility yourself.

3. Accounts and Membership

Account Registration and Login

• You can register or log in with your email and a verification code, which is sent to your email address solely to prove ownership of that email; currently we do not offer third-party login with WeChat, Google, or Apple;
• New accounts receive a free 1-month trial. After the trial expires, free features such as music import, BPM analysis, and the library remain available, while the player feature requires a membership to unlock;
• You should ensure the truthfulness and accuracy of your registration information and are responsible for actions under your account;
• Please keep your account information safe. Losses caused by your disclosure of account information are borne by you, except as otherwise provided by laws and regulations.

Account Deletion

You can delete your account at any time under Settings - Account - Delete Account. After deletion, we will delete or anonymize the relevant personal information in accordance with the Privacy Policy.

Membership Services

• Membership is a digital virtual service. Once membership is activated and credited, no-refund requests for no reason are not supported, except as otherwise provided by laws and regulations or expressly permitted by app store rules;
• Membership benefits are subject to the in-app descriptions and purchase pages. We may adjust the scope of membership benefits based on operational circumstances, but will not unreasonably cancel benefits you have purchased that are still within their validity period;
• If membership features involve auto-renewal, the specific billing cycle, price, and cancellation method are subject to the purchase page and Section 6 of these Terms.
• Membership purchases are completed through in-app purchases on the Apple App Store, Huawei AppGallery, and Tencent MyApp. iOS subscription status is provided by the third-party service RevenueCat, while Android entitlements take effect after our service verifies the purchase credential.

4. User Conduct

You agree not to use this App for the following:

1. Importing, uploading, or spreading music or content that infringes the intellectual property, copyright, portrait rights, privacy, or other legitimate rights and interests of others;
2. Importing, uploading, or spreading content that is illegal, pornographic, violent, gambling-related, terrorist, or otherwise in violation of Chinese laws and regulations;
3. Reverse engineering, decompiling, cracking, or tampering with this App, or attempting to bypass the App's authorization and security mechanisms;
4. Mass-registering accounts, manipulating metrics, interfering with other users' normal use, or attacking app services;
5. Commercially distributing content generated with this App unless you have obtained authorization from the relevant music rights holders;
6. Engaging in other behavior that violates laws and regulations, app store rules, or harms others' legitimate rights and interests.

If you violate the above commitments, we have the right to take measures such as warnings, feature restrictions, suspension, or termination of services depending on the circumstances, and reserve the right to pursue legal liability.

5. Intellectual Property

1. The intellectual property rights in this App's software, icons, interface design, copy, algorithms, code, and related materials belong to us or the corresponding rights holders;
2. You retain the intellectual property rights in the music files you import; you only authorize us to process this music locally on your device for the purpose of using this App;
3. Mixes, playlists, and other works you generate with this App are for your personal use only; if you need to share, distribute, or use them commercially, please make sure you have obtained authorization from the corresponding music rights holders.

6. Payments and Subscriptions (If Applicable)

Products and Pricing

• The specific name, price, cycle, and benefits of membership products are subject to the in-app purchase pages and the corresponding app store pages;
• We may adjust prices based on operational needs; adjusted prices apply to purchases made after the adjustment and do not affect subscription cycles already in effect.

Auto-Renewal

• Auto-renewing subscriptions will automatically renew according to your chosen cycle before the current subscription period expires;
• How to cancel: iOS users can cancel under Settings - Apple ID - Subscriptions; Huawei / MyApp users can cancel in the order / subscription management pages of the corresponding store; please cancel at least 24 hours before expiration to avoid the next charge;
• The specific cancellation process is subject to the latest rules of Apple, Huawei, and Tencent MyApp.

Restore Purchases and Refunds

• After changing devices or reinstalling the App, you can restore purchased membership benefits under Settings - Account - Restore Purchases;
• Subscription or purchase payments are collected and settled by Apple, Huawei, Tencent MyApp, and other stores. Refund requests should be handled through the corresponding app store channel.

7. Disclaimers

1. This App is provided "as is"; we do not guarantee absolute stability, error-free operation, or uninterrupted availability of the services;
2. Please assess your own physical condition before running or exercising. The BPM suggestions, playlists, and other content provided by this App do not constitute medical, health, or exercise prescription advice. If you feel unwell during exercise, stop immediately and consult a professional doctor;
3. You are responsible for the legality of the music content you import and how you use it; we are not liable for consequences arising from your improper use;
4. We are not liable, to the extent permitted by law, for service interruptions, delays, or data loss caused by network or device failures, app store policy changes, or force majeure.

8. Limitation of Liability

To the maximum extent permitted by laws and regulations, we are not liable for the following losses: indirect, incidental, punitive, lost profit, goodwill, or data loss, even if we have been informed of the possibility of such losses. Our aggregate liability is limited to the fees you actually paid for this App.

9. Changes and Termination

1. We may update these Terms based on business changes or legal requirements. Updated Terms will be notified in the app or through other appropriate means and take effect on the date of publication;
2. You can stop using this App at any time;
3. If you materially breach these Terms, we have the right to suspend or terminate services to you and reserve the right to pursue liability in accordance with the law;
4. Termination of services does not affect rights and obligations arising before termination, nor the validity of clauses that should survive by law (such as intellectual property, limitation of liability, and dispute resolution).

10. Governing Law and Disputes

1. The formation, performance, interpretation, and dispute resolution of these Terms are governed by the laws of the People's Republic of China;
2. Disputes arising from these Terms shall first be resolved through friendly negotiation; if negotiation fails, either party may file a lawsuit with the competent people's court at the developer's place of residence.

11. Minors

Minors under 14 years of age should use this App under the guidance of a guardian after the guardian has read and agreed to these Terms and the Privacy Policy.
